POLICIES, TERMS & CONDITIONS

For Diamond Furniture, Inc., hereinafter called DIAMOND FURNITURE

WARRANTY:

Diamond Furniture reserves the right to inspect & determine the cause on any and all claims of defects or damages. Furniture is guaranteed against all manufacturer’s defects for a period of thirty (30) days from the original date the merchandise is delivered or picked up. Diamond Furniture will provide service to repair any such defects & restore goods to merchantable condition. THERE WILL BE NO  EXCHANGES. Necessary service will be performed at the discretion of Diamond Furniture, either in the customers home or in our shop or merchandise may have to be returned to the manufacturer’s factory for repair depending on the nature of the necessary repairs.  Customer shall be responsible for paying for all charges for repairs and transportation if not covered by warranty. No guarantee is made as to wear or color fastness of fabrics on upholstered pieces, or ticking on bedding. Diamond Furniture assumes no responsibility for normal wear & tear, or any damages caused by customer abuse or misuses during the guarantee period. If merchandise is picked up, Diamond Furniture assumes no responsibility for any damages caused by customers handling and all warrantees are voided. If merchandise is not delivered by a Diamond Furniture endorsed independent contractor, customer will be responsible for transportation to and from the repair facility.  Any item(s) sold "AS IS" does not have any warranty. Lacquer, plastic, or painted finishes are not guaranteed for scratches or small nicks, as it is the nature of the product.  An additional 12 month warranty is available for purchase at an additional cost prior to pick-up or delivery.  Fabric Protection and Wood Care products are warranted by the manufacturer NOT Diamond Furniture.

BEDDING FLAMMABILITY STANDARDS:

  • All bedding manufactured after July 1, 2007 is compliant with flammability standard 16 CFR part 1633

  • Consumer should not mix flame retardant with non flame retardant pieces.  Concerning same, Diamond Furniture does not have any responsibility and/or liability, whatsoever once consumer takes possession of bedding.

FURNITURE & BEDDING FACTS:

Furniture is not perfect; display samples are indicative of what you may expect upon delivery or pick-up. Since all upholstery fabric is cut at random match there is a possibility that the upholstery patterns will not exactly line up with each other at seamed areas. Since no two pieces of wood are exactly alike, there is a possibility of variation of the coloring or graining even though identical finishing materials are used. This is the nature of the woods and is not a defect. Atmospheric conditions or heat radiation may cause wearing or drying of wood finishes or lightening of fabric.  Diamond Furniture will not be responsible for furniture pieces which do not sit level because of uneven floors.

DELIVERY:

ANY PROMISE OF DELIVERY TIME BY ANY EMPLOYEE IS ONLY AN ESTIMATE AND NOT BINDING. Any statements or promises of special services made by any employee are not valid and may not be honored unless written on the order, signed by that employee and approved by a manager. See other terms and conditions under “DELIVERY INFORMATION”. Diamond Furniture will assume absolutely no responsibility when it is found that the doorway, hallway, staircase, elevator, or any access point at a customer’s delivery address is too small or narrow to facilitate the delivery of the merchandise. The customer is required to re-select other merchandise. In cases where the merchandise has been Special Ordered, the customer will be liable for the full purchase price of the merchandise. The customer is responsible to pay a delivery charge and re-delivery / re-stocking charge.  Where circumstances require delivery through a window or any special delivery service (i.e. rigging, etc.) the customer will be required to pay an additional delivery charge directly to the independent delivery service in cash, at time of delivery. Sales orders are not subject to refund.  For ALL  AUTHORIZED RETURNS merchandise must be in good condition and acceptable for resale. For ALL TELEPHONE and INTERNET orders, a restocking charge of twenty percent (20%) of the merchandise total will apply in addition to the original delivery fee and a "pick-up charge" equal to the original delivery charge. 

SPECIAL ORDERS - Payment in full is required before ordering from the manufacturer.  We cannot guarantee delivery dates on special orders and/or manufacturer direct shipped merchandise. We are not responsible for delays, non-delivery due to circumstances beyond our control, or factory discontinuations. Special Orders are not subject to cancellation, return, or refund of payment(s) made. If buyer does not accept delivery / pick-up after 30 days when merchandise is available , Diamond Furniture shall have right to retain the payment(s) to cover seller’s loss of profit and other costs and expenses incurred by the seller.

OTHER TERMS:

NO C.O.D. payments. Final payment by cash, personal check or credit card ONLY are accepted at store at least 24 hours before delivery or transport of merchandise to branch store for pick-up. Money orders, cashiers checks and certified checks need 21 days before merchandise can be released for delivery or pick-up.  Floor samples are not subject to return and are sold "as-is". ALL SALES ARE FINAL.  If you finance and your sale is not approved, your sale will automatically convert to a "Layaway" plan.  Any Finance sale that converts to "Layaway" plan shall have any and all "Layaway" plan rules applied. Diamond Furniture reserves the right to substitute comparable merchandise for "Layaway" merchandise. If no payment has been made for three (3) months, your 'Layaway" plan will expire and you will forfeit all monies. All customer pick-ups must have original receipt and must be original buyer(s).

DELIVERY INFORMATION & DISCLOSURE

● It is impossible to give a specific time of delivery.

● NO C.O.D. Final payment by cash, personal check or credit card is required 24 hours before delivery.

● All packaging material associated with delivery will be placed in your designated trash area; drivers will not remove or take away any trash or packing materials on delivery trucks.

● PICK-UP INFORMATION:  If you choose to pick-up your merchandise, Diamond Furniture assumes no responsibility for any damages cause by customer's handling and all warranties are voided.  If merchandise is not delivered by one of our independent outside contractors, customer will be responsible for transportation to and from repair facility/store.  SEE STORE FOR FURTHER DETAILS.

● Delivery of merchandise is provided by an independent, outside contractor and not connected in any way with Diamond Furniture Inc.  Diamond Furniture Inc. has no responsibility nor liability whatsoever for any damage to furniture and/or customer’s property created by the delivery service or their negligence or as a result of customers instructions or any liability or responsibility on any matter whatsoever.

● Customer is responsible for supplying proper address, crossroads, directions, day time phone number, BEFORE DELIVERY.

REDELIVERY CHARGE!  If your merchandise is not delivered on the scheduled delivery date because you are not at home or do not accept delivery for any reason, you will be charged an additional FULL RE-DELIVERY/RE-STOCKING CHARGE.

● Because of loading schedules, Diamond Furniture’s delivery services cannot move, rearrange or haul away old furniture.

Refund Policy and Additional Information About Your Diamond Furniture Purchase

● NO REFUNDS after 72 hours from the date sale was written if delivery or pick-up has NOT been attempted.

● NO REFUNDS regardless of 72 hour time frame if delivery or customer pick-up HAS been attempted.

● Qualified refunds are only issued to original buyer(s) with proper ID and surrender of the original sales receipt.

NOTE: See above two points.

● ALL REFUNDS OVER $25 will be processed and issued via check from our Corporate Headquarters in approximately 21 business days.

● REFUNDS FOR NEW JERSEY SALES ONLY: Any merchandise that you order is promised for delivery to you on or before sixteen (16 ) weeks from the date of purchase. If the merchandise ordered by you is not delivered within the promised delivery time, Diamond Furniture & Mattress, Inc. must offer you the choice of (1) canceling you order with a prompt, full refund of any payments made, or (2) accepting delivery at a specific later date.

● Any Coupons, gift certificates, or Diamond Furniture promotional discounts are non-refundable.

● Special Orders or Manufacturers Direct Ships must be paid in full and may take up to 12-16 weeks (or longer) from the date payment in full is received.  Diamond Furniture Inc. uses it’s best efforts to ensure that your merchandise is available as agreed on the original sales order but is not responsible for manufacturer delays, factory errors, factory discontinuations and/or other such inconveniences.

● Diamond Furniture will charge tax (state and local) where applicable on all sales orders including all purchases made online.

● A small deposit (less than 25% of sale) will protect the price for seven (7) days.

● One year free “Layaway” is available. Your sales order will not be price protected until the 25% minimum deposit has been paid. Monthly payments are required, 1/12th of total. If a payment is not received for three months, sale will be voided and all deposit money is forfeited.  “Layaway” sales orders are subject to manufacturer availability. If merchandise is no longer available, you MUST re-select merchandise and use your deposit(s) towards its purchase.  You will not receive a refund.

● ALL ITEMS MARKED “ASSEMBLY REQUIRED” WILL NOT BE ASSEMBLED whether merchandise is delivered or pick-up.
